These Terms of Use ("Terms") govern access to and use of the website, mobile application, and related services operated under the brand "PGverse" by Pindila Solutions Private Limited. By accessing or using PGverse, you agree to be bound by these Terms. If you disagree with any part, please do not use the Platform.
Acceptance of Terms
These Terms constitute a legally binding agreement between you ("User") and Pindila Solutions Private Limited ("Company", "PGverse", "we", "us"), governing your access to and use of:
- The website at pgverse.in and all subdomains
- The PGverse mobile application (iOS and Android)
- WhatsApp-based services offered under the PGverse brand
- Any APIs, widgets, or tools integrated with third-party services
These Terms must be read together with our Privacy Policy, which is incorporated herein by reference. By clicking "I Agree", verifying an OTP, registering an account, or continuing to use the Platform, you confirm that you have read, understood, and agreed to these Terms.
Eligibility
To use PGverse, you must:
- Be at least 18 years of age and competent to enter into a legally binding contract under the Indian Contract Act, 1872
- Be a resident of India or a foreign national legally residing in India
- Not be barred from using our services under any Applicable Law
Entities and businesses may register as Property Owners through an authorised signatory who confirms they have the requisite authority to bind such entity to these Terms.
Registration & KYC
To access certain features, you must register and create an account by providing accurate, current, and complete information, including OTP-based verification. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
Certain features, including listing a property, confirming a booking, or receiving payouts, require successful completion of KYC verification in accordance with our Privacy Policy. We reserve the right to request additional documentation, conduct re-verification periodically, or decline to activate features where KYC is incomplete, unsuccessful, or where submitted documents appear fraudulent or inconsistent.
Platform Use — Acceptable & Prohibited
You May
- Browse PG listings and filter by area, budget, type, and amenities
- Submit enquiry forms to request a PG visit or callback
- Create an account and manage your PG profile as a resident
- List your PG as a verified owner on our platform
You Must Not
- Provide false, misleading, or fraudulent information at any point
- Use the platform to harass, threaten, or harm other users
- Scrape, copy, or reproduce any content or listings from PGverse without permission
- Attempt to bypass authentication, access other accounts, or exploit security vulnerabilities
- Use PGverse for any commercial purpose other than managing or finding a PG
- Post or distribute spam, malware, or any unlawful content
- Impersonate PGverse staff, PG owners, or other users
Violation of prohibited activities may result in immediate account suspension, legal action, and reporting to relevant authorities.
Tenant Responsibilities
Tenants are solely responsible for independently verifying property details, and agree to:
- Provide accurate personal details when requesting a PG visit or booking
- Understand that PGverse acts as a facilitator — the actual tenancy agreement is between you and the PG owner directly
- Comply with the house rules of the PG you reside in
- Not misuse the maintenance ticketing system for non-genuine complaints
- Not share your login credentials with other persons
PGverse is not responsible for disputes arising from your direct tenancy agreement with a PG owner. However, we provide a grievance escalation mechanism — contact support@pgverse.in for assistance.
Property Owner Responsibilities
Property Owners are solely and exclusively responsible for:
- The legality of the listed property and its use as a PG accommodation, including compliance with local municipal, zoning, fire-safety, and building regulations
- Their ownership of, or lawful authority to lease, the listed property
- The safety, habitability, cleanliness, and maintenance of the property
- The accuracy of all information, pricing, amenities, photographs, and availability displayed in their Listing
- Obtaining and maintaining all licences, registrations, NOCs, and statutory approvals required to operate a PG accommodation
- Timely payment of all applicable taxes, including GST and income tax, arising from rental income earned through the Platform
- Honouring confirmed Bookings in accordance with the terms communicated to the Tenant
Property Owners shall not list any property they do not own or are not lawfully authorised to lease. PGverse reserves the right to delist any PG that fails to meet our verification standards or violates any of these Terms — without prior notice.
Payments & Fees
For Tenants
- Browsing PGverse and requesting a visit is completely free
- Failed or disputed payments are handled per our Refund Policy
For PG Owners
- PGverse offers a free listing tier and premium subscription plans
- Subscription fees are billed monthly or annually, as chosen at the time of purchase, via Razorpay
- Refunds on subscription plans are governed by our Refund Policy
All payments on PGverse are processed via RBI-licensed, PCI-DSS compliant payment gateways. We do not store card or bank account details on our servers.
Intellectual Property
All content on PGverse — including the brand name, logo, website design, listing data, photographs, text, and software — is the intellectual property of Pindila Solutions Private Limited or its licensors, protected under Indian copyright and trademark law.
You may not reproduce, distribute, modify, or create derivative works of any content from PGverse without explicit written permission. By submitting content to PGverse (e.g., PG photos, reviews), you grant us a non-exclusive, royalty-free, worldwide licence to display and use that content on our Platform.
Limitation of Liability
PGverse is a marketplace and technology facilitation platform. We connect Tenants with Property Owners but are not a party to the tenancy agreement between them. Accordingly:
- We are not liable for the quality, safety, legality, or condition of any listed PG
- We are not liable for disputes between Tenants and Property Owners arising from the tenancy
- We are not responsible for inaccuracies in listings where the owner has provided false information
- Our aggregate liability, if any, shall be limited to the extent permitted under Applicable Law
Nothing in these Terms limits liability for death, personal injury, or fraud caused by our gross negligence or wilful misconduct. PGverse shall not be liable for any failure or delay in performing its obligations arising from circumstances beyond its reasonable control (Force Majeure), including natural disasters, pandemics, war, governmental action, or failure of third-party service providers.
Termination
- By You: Delete your account from settings, or email support@pgverse.in. Deletion is processed within 30 days.
- By Us: We may suspend or terminate your access immediately if you violate these Terms, engage in fraudulent activity, or if required by law — without prior notice or liability.
Upon termination, your right to use the Platform ceases immediately. Sections relating to intellectual property, liability, and governing law survive termination.
Electronic Records & Digital Acceptance
These Terms constitute an electronic record within the meaning of the Information Technology Act, 2000, and do not require any physical or wet signature to be valid and enforceable. Your acceptance through the Platform — including by clicking "I Agree", checking a consent checkbox, verifying an OTP, or completing a digital signature flow — constitutes valid and legally binding electronic acceptance under Sections 10A and 65B of the IT Act. PGverse maintains a system-generated record of the date, time, and method of your acceptance as conclusive evidence of such acceptance, absent manifest error.
Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of India. Any dispute shall first be referred to good-faith negotiation between the parties for at least 30 days. If unresolved, the dispute shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator, with the seat and venue of arbitration at Noida, Uttar Pradesh, India, in the English language.
Subject to arbitration, the courts at Noida (Gautam Buddha Nagar), Uttar Pradesh, India shall have exclusive jurisdiction over matters not referable to arbitration. Nothing in this clause prevents a User from exercising any statutory right to approach a consumer forum where such right cannot be excluded by agreement under Applicable Law.
Grievance Redressal Mechanism
In accordance with the Information Technology Act, 2000, the Consumer Protection (E-Commerce) Rules, 2020, and the Digital Personal Data Protection Act, 2023, PGverse has appointed a Grievance Officer to address queries and grievances relating to these Terms and use of the Platform.
We endeavour to acknowledge grievances within 48 hours and resolve them within the timelines prescribed under Applicable Law, generally not exceeding 30 days.
